These Terms of Service ("Terms") govern your use of the website located at https://www.bugsway.com (the "Website") and your engagement of pest control services from Bugsway Pest Control ("Bugsway", "we", "us", or "our"), operating in Toronto, Ontario, Canada. By using our Website or engaging our services, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree with any part of these Terms, you must not use our Website or engage our services.

1. Services

1.1 Service Description

Bugsway Pest Control provides residential and commercial pest control services in Toronto and the Greater Toronto Area, Ontario, Canada. Services include but are not limited to: pest identification and inspection, chemical and non-chemical pest treatment, rodent exclusion, and ongoing pest prevention programs.

1.2 Service Eligibility

Our services are available to property owners and authorized occupants of residential and commercial properties located within our service area. By booking services, you confirm that you are authorized to consent to pest control treatment at the property in question.

1.3 Service Limitations

Bugsway makes commercially reasonable efforts to eliminate pest infestations. However, due to the nature of pest biology and environmental factors outside our control, we cannot guarantee complete pest elimination in all circumstances. Treatment guarantees, where offered, are limited to the specific terms stated at the time of service booking.

2. Booking and Scheduling

2.1 Appointments

Service appointments may be booked through our website, by telephone, or by email. Appointment times are estimates; while we endeavour to arrive within stated windows, delays due to traffic, previous appointments, or other factors may occur. We will make reasonable efforts to communicate any significant delays.

2.2 Cancellation and Rescheduling

We request a minimum of 24 hours notice for appointment cancellations or rescheduling. Cancellations with less than 24 hours notice may be subject to a cancellation fee of up to $75 + applicable taxes. Emergency appointments cancelled or rescheduled with less than 4 hours notice may be subject to an emergency dispatch fee.

2.3 Client Preparation

Certain services require client preparation prior to treatment (e.g., clearing areas, removing pets, laundering bedding). Failure to complete required preparation may result in rescheduling at the client's expense or reduced treatment effectiveness, for which Bugsway accepts no liability.

3. Pricing and Payment

3.1 Pricing

Service pricing is provided at the time of booking confirmation. All prices are in Canadian dollars and are subject to applicable federal and provincial taxes (currently 13% HST in Ontario).

3.2 Payment Terms

Payment for residential services is due at the time of service delivery unless otherwise agreed in writing. Commercial account billing terms are as specified in the applicable service agreement. We accept cash, credit card, debit, and e-transfer.

3.3 Price Changes

Prices for ongoing service contracts are subject to annual adjustment with 30 days written notice. One-time service prices are fixed at the time of booking confirmation.

4. Warranties and Guarantees

4.1 Service Guarantee

Where Bugsway provides a written service guarantee, the terms of that guarantee (including the duration, scope, and conditions for invoking the guarantee) are as stated in your service confirmation. Service guarantees are subject to the client maintaining the property in accordance with Bugsway's post-treatment recommendations and allowing Bugsway access for follow-up treatment.

4.2 Limitation of Warranty

EXCEPT AS EXPRESSLY STATED IN A WRITTEN SERVICE GUARANTEE, ALL SERVICES ARE PROVIDED "AS IS" AND BUGSWAY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR GUARANTEED RESULTS.

5. Limitation of Liability

5.1 Maximum Liability

To the maximum extent permitted by applicable Ontario law, Bugsway's total liability to you for any claims arising from or relating to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

5.2 Exclusion of Consequential Damages

Bugsway shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, loss of profits, loss of data, or business interruption, arising from or related to our services or website, even if advised of the possibility of such damages.

5.3 Property Damage

Bugsway maintains comprehensive general liability insurance. Any claims for property damage alleged to have been caused by Bugsway must be reported in writing within 72 hours of the service visit. We will investigate all reasonable damage claims in good faith.

6. Client Obligations

By engaging Bugsway's services, you agree to:

• Provide accurate and complete information about the pest problem and property conditions
• Ensure safe access to all areas requiring treatment
• Remove or secure pets, children, and individuals with known chemical sensitivities from treatment areas as directed
• Follow all post-treatment instructions provided by Bugsway technicians
• Notify Bugsway of any known hazardous materials on the property prior to treatment

7. Intellectual Property

All content on the Bugsway website, including text, images, graphics, logos, and software, is owned by or licensed to Bugsway and is protected by Canadian copyright law. You may not reproduce, distribute, or create derivative works from our content without express written permission.

8. Website Use

8.1 Permitted Use

You may use our website for lawful purposes only — to access information about our services, request quotes, book appointments, and read our blog content.

8.2 Prohibited Activities

You must not use our website to: transmit malicious code or conduct automated data scraping; impersonate Bugsway or any of our employees; submit false or misleading information; or engage in any activity that could damage, disable, or impair the website.

9. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Ontario.

Before initiating any legal proceedings, you agree to provide Bugsway with written notice of the dispute and 30 days to resolve the matter through good-faith discussion.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through our website. Your continued use of our website or services following any changes constitutes your acceptance of the revised Terms.
